Welcome to event-market.co.uk (“Event Market”, “we”, “us” or “our”).

These Terms & Conditions govern your use of our website, services, accounts and listings. By accessing or using Event Market, you confirm that you accept these Terms. If you do not agree, you must not use the website.

1. About Event Market

Event Market is an online marketplace for event-related equipment, structures, services and suppliers.

We provide a platform where users may advertise, discover and contact buyers, sellers, hire companies, service providers and other event-industry businesses.

Unless we expressly state otherwise, Event Market is not the seller, supplier, hirer, owner or provider of items or services advertised on the website. We do not own, inspect, store, transport, deliver or insure items listed by third parties.

2. Definitions

In these Terms:

• Buyer means a user looking to purchase, hire or enquire about a listing.
• Seller means a user who posts a listing, offers goods, equipment or services, or otherwise acts as a supplier through Event Market.
• Listing means any advert, item, service, image, text, price, video or other content posted on Event Market.
• User means anyone who accesses or uses Event Market, whether registered or not.
• Services means the website, user accounts, listings, featured listings, advertising services and other services provided by Event Market.

3. Who may use Event Market

You must be at least 18 years old to create an account, post a listing or enter into a transaction through Event Market.

By using the website, you confirm that:

• the information you provide is accurate, complete and up to date;
• you have the legal right to offer any goods, equipment or services you list;
• you will use Event Market lawfully and responsibly; and
• you will comply with all applicable laws, regulations, licences, insurance requirements and safety obligations.

If you use Event Market on behalf of a company, partnership or other organisation, you confirm that you have authority to accept these Terms on its behalf.

4. Our role as a marketplace

Event Market is a listing and connection platform only.

Unless expressly stated otherwise in writing, any agreement for the sale, hire, supply, delivery, installation or provision of services is made directly between the Buyer and Seller.

We are not a party to those agreements and are not responsible for:

• the accuracy, quality, condition or legality of listed items or services;
• whether an item is available, delivered, installed or collected;
• whether a service is completed correctly or on time;
• cancellations, refunds, deposits, disputes or chargebacks;
• loss, damage, injury or other issues arising from transactions between Users.

Users are responsible for carrying out their own checks before entering into a transaction. This may include checking identity, business status, insurance, references, product condition, safety certificates, PAT testing, public liability cover, suitability, availability and payment arrangements.

5. Accounts

You may need to create an account to post listings or use certain features.

You are responsible for:

• keeping your account details and password secure;
• ensuring that information in your profile remains accurate;
• all activity carried out through your account;
• notifying us promptly if you believe your account has been accessed without permission.

You must not create multiple accounts to avoid restrictions, mislead other users or manipulate listings, reviews or search results.

We may suspend, restrict or close an account where we reasonably believe that these Terms have been breached or that the account presents a risk to Event Market or other users.

6. Listings and Seller responsibilities

Sellers are responsible for all content, claims, prices and information included in their listings.

All listings must be accurate, clear and lawful. Sellers must ensure that listings do not contain false, misleading, incomplete or deceptive information.

Sellers must clearly state, where relevant:

• whether the item is for sale, hire or both;
• the price, hire rate, deposit, VAT position and any additional charges;
• the item’s condition, defects, limitations or missing parts;
• delivery, installation, collection and cancellation arrangements;
• whether the Seller is acting as a business or private individual;
• any safety requirements, licences, insurance requirements or restrictions.

Sellers must not list equipment or services that they do not have the right or genuine intention to provide.

Sellers are responsible for ensuring that all equipment and services comply with applicable legal and safety requirements. This includes, where relevant, electrical safety, fire safety, product safety, public liability insurance, licences, certifications and safe operating instructions.

7. Prohibited listings and conduct

You must not use Event Market to post, promote, sell, hire, request or arrange:

• illegal, stolen, counterfeit or unsafe goods;
• goods or services that infringe another person’s intellectual property rights;
• misleading, fraudulent or deceptive listings;
• weapons, explosives, illegal drugs or controlled substances;
• adult, offensive, discriminatory, abusive or unlawful content;
• content containing viruses, malware or harmful code;
• listings designed to collect personal data improperly or mislead users;
• spam, unsolicited advertising or repeated duplicate listings;
• any activity that may damage the reputation, operation or security of Event Market.

We may remove, edit, suspend or restrict access to any listing or account that we reasonably believe breaches these Terms, creates legal or safety concerns, or may harm users or Event Market.

8. Buyers and transactions

Buyers must make their own checks before entering into a transaction.

Before making payment, collecting an item or booking a service, Buyers should confirm key details directly with the Seller, including:

• price and any VAT;
• availability;
• condition and suitability;
• delivery or collection arrangements;
• deposit and cancellation terms;
• insurance, licences and safety requirements.

Event Market does not verify every listing, Seller or Buyer. A listing appearing on Event Market does not mean that we endorse, guarantee or recommend that user, item or service.

Where a Seller is a business and a Buyer is a consumer, the Seller remains responsible for complying with applicable consumer protection laws.

9. Payments and paid services

Unless clearly stated otherwise, Event Market does not process, hold or guarantee payments made between Buyers and Sellers.

Any payment, deposit, refund or charge relating to a transaction between Users is arranged directly between those Users.

Event Market may offer paid services, such as featured listings, advertising, subscriptions or promotional placement. Where paid services are available:

• the applicable price and payment terms will be shown before purchase;
• fees may be subject to VAT where applicable;
• fees are payable in advance unless stated otherwise;
• paid placement does not guarantee a sale, booking, response, enquiry volume or particular search ranking;
• we may remove or suspend a paid listing if it breaches these Terms, without refund where permitted by law.

Any statutory cancellation rights that apply to consumers are not affected by these Terms.

10. Reviews, ratings and user-generated content

Users may be able to leave reviews, ratings, comments, images, videos or other content.

You must ensure that content you post:

• is accurate and genuinely reflects your experience;
• is not defamatory, abusive, threatening, discriminatory or misleading;
• does not disclose private or confidential information;
• does not infringe another person’s rights.

By posting content on Event Market, you grant us a non-exclusive, worldwide, royalty-free licence to host, display, reproduce, adapt, publish and promote that content for the purpose of operating, improving and marketing Event Market.

You remain responsible for content you submit.

11. Intellectual property

All rights in the Event Market name, branding, website design, software, text, graphics, logos and other materials belonging to us remain our property or the property of our licensors.

You may not copy, reproduce, distribute, modify, scrape, reverse engineer or commercially exploit any part of Event Market without our written permission.

You retain ownership of content that you upload, but you confirm that you have the necessary rights to use and publish it.

12. Third-party websites and services

Event Market may contain links to third-party websites, social media platforms, maps, payment services or other external services.

We do not control those third parties and are not responsible for their content, availability, security, privacy practices or terms.

Your use of third-party services is subject to their own terms and policies.

13. Availability of the website

We aim to keep Event Market available and functioning properly, but we do not guarantee that the website will always be uninterrupted, secure, error-free or free from viruses.

We may update, modify, suspend or withdraw any part of the website at any time for operational, security, maintenance or business reasons.

14. Liability

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited, including liability for fraud, fraudulent misrepresentation, death or personal injury caused by negligence, or any statutory rights that apply to consumers.

Subject to the above:

• Event Market is not responsible for transactions, disputes, losses or damage arising between Buyers and Sellers;
• we are not liable for indirect or consequential losses, loss of profit, loss of business, loss of goodwill, loss of data or loss of opportunity;
• we are not liable for inaccuracies, omissions or changes in third-party listings;
• users use Event Market and deal with other users at their own risk.

Where we are liable to you in connection with paid Event Market services, our total liability will not exceed the amount you paid to us for those services during the 12 months immediately before the event giving rise to the claim.

15. Indemnity for business users

If you use Event Market in the course of business, you agree to indemnify Event Market against losses, claims, liabilities, costs and expenses arising from:

• your listings, content, products or services;
• your breach of these Terms;
• your breach of applicable laws or third-party rights;
• a dispute between you and another user.

16. Privacy

Our use of personal data is explained in our Privacy Policy.

By using Event Market, you acknowledge that we may process personal data in accordance with that policy.

17. Suspension and termination

We may, at our discretion, remove content, restrict listings, suspend accounts or block access where we reasonably believe that:

• these Terms have been breached;
• a user has acted unlawfully, dishonestly or abusively;
• a listing may be unsafe, misleading or fraudulent;
• this is necessary to protect Event Market, its users or the public;
• we are required to do so by law or a regulator.

Where appropriate, we may give notice of the action taken. However, we may act immediately where this is necessary for security, legal, safety or fraud-prevention reasons.

18. Changes to these Terms

We may update these Terms from time to time.

The latest version will always be published on Event Market with the date of the most recent update. Continued use of the website after changes take effect means that you accept the updated Terms.

19. Governing law and jurisdiction

These Terms are governed by the laws of England and Wales.

Any dispute relating to these Terms or your use of Event Market will be subject to the courts of England and Wales, except where mandatory consumer protection laws provide otherwise.
